This case comes before the Court on plaintiff’s motion for a preliminary injunction 1 and defendant’s motion for summary judgment, or in the alternative, to dismiss.2

Very briefly, the facts are as follows: On or about August 20,, 1973, the plaintiff signed a contract3 with the Navy under the Armed Forces Health Professions Scholarship Program (Program), 10 U.S.C. § 2120 et seq.
