Harleysville Mutual Insurance Company (hereinafter “Harleysville”) filed a petition for a declaratory judgment against the Philadelphia Transportation Company (hereinafter “PTC”) and Anna Mae Rainer (hereinafter “Rainer”). The petition alleged that Rainer was a paying passenger on a PTC trolley and suffered personal injuries when the trolley collided with a vehicle operated by an uninsured motorist.
