OPINION AND ORDER

GARCIA-GREGORY, DISTRICT JUDGE. 1

On July 11, 2002, defendants Juan Torres (“Torres”) and Margarita Carrasquillo (“Carrasquillo”) moved to dismiss plaintiffs Candido Neris (“Neris”) and Monica Rue-da’s (“Rueda”) (collectively “plaintiffs”) complaint pursuant to Fed.R.Civ.P. 12(b)(6). (Docket No. 10.) On September 5, 2002, Neris and Rueda filed an Amended Complaint (Docket No. 17) and an opposition (Docket No. 18). For the reasons discussed below, the Court grants the motion with respect to the § 1985 claims and denies the motion with respect to the § 1983 claims.
