delivered the opinion of the court:

In December 1970, the defendant William Brown entered a plea of guilty to the offense of burglary in the circuit court of Logan County and was sentenced to a term of 2 to 5 years in the penitentiary. No appeal was taken. In August 1972, the defendant filed a pro se petition for post-conviction relief which was denied on June 13, 1973, by the trial court without an evidentiary hearing.
