The courts below have unanimously sustained a demurrer to the complaint on the ground that it did not state a cause of action. The action is plainly one to procure a judicial construction of a will and to procure a judgment that the plaintiff is entitled, under the provisions of the will, to a legacy or a charge in her favor upon the estate disposed of by the will, or to procure a judgment that the will creates a trust in her favor. • It is alleged that the defendant’s husband,1 William T.
