This matter is before the Court on defendant Kenneth Desmond’s motion to dismiss for lack of diversity pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure. The suit arises from an incident in a Newport bar in which plaintiff, Mark C. Murphy, claims he was wrongfully assaulted by the bar’s doorman, Kenneth Desmond. Murphy brought suit against both the bar, The Newport Waterfront Landing, Inc. (“The Landing”), and the doorman.
