This is a petition by the mayor of the city of Lynn for a writ of mandamus whereby it is sought to compel the commissioner of civil service and the two associate commissioners to certify to him for appointment in the fire department the name of the person receiving the highest grading in the marking on the competitive examination held by them in accordance with law. The respondents, although requested, refused to certify the name of that person for the reason that he was not a veteran.
