This is an action for malicious prosecution. The petition is in two counts. The first count is based on the original arrest and prosecution of plaintiff before a justice of the peace in Stoddard County on the preliminary hearing, charging burglary of an express office, and the second count is based on a subsequent prosecution in the circuit court for the same offense after his discharge by the justice.
