This controversy arises upon a case stated, in which the following are the essential facts:
John W. Geist, upon a plea of guilty of selling intoxicating liquors, was sentenced to pay a fine of $1000 and the costs of prosecution, or to give bail to pay the same within ten days, and was committed to the custody of the sheriff until his sentence was complied with. He paid the fine of $1000 to the *619sheriff, and on the same day paid the costs.
