Todd, J.

The relator obtained a judgment against the respondents in the district court of the parish of St. John the Baptist. From this judgment an appeal was taken to tlie Circuit Court of Appeals for said parish.

In that court a motion to dismiss the appeal was made on the ■. ground of want of jurisdiction in said court ratione material.

This motion was denied and the court proceeded to try the cause, and reversed the judgment of the district court.
