The defendant, Joseph Melvern (appellant here), was convicted in the superior court of Snohomish county of murder in the second degree, upon the trial of an information charging him with murder in the first degree for the hilling of one Clara Melvern by shooting her with a pistol. A motion for a new trial was filed and overruled, and the court thereupon sentenced the defendant to the penitentiary for the period of twenty years.
