Introduction

Presently before the court is Defendant’s February 9 application for a sen*456tencing hearing. Defendant is scheduled to be resentenced to a mandatory sentence life without parole on February 21, 2017. In his application, Swan contends that the court is not obligated to sentence him to life without parole and he is entitled to a sentencing hearing after which the court may sentence' him to something less.
