Motion was made to quash the indictment because of its vagueness and indefiniteness, and because it is nowhere alleged that the house known as Bolla Bagley’s house, where Dock Bagley had been living, was not a private residence. The perjury is alleged to have been committed before a justice of the peace, wherein said justice was inquiring as to whether appellant had, “at a house known as Bolla Bagley’s, where Dock Bagley had been living, in the city of Lampasas, on the night of October 30, 1905, seen Clay Huling, H.
