On the sixteenth day of June, 1883, at Howard, in Miner county, Dakota, Francis M. Lighthizer made a general assignment of all his property to the plaintiff, for the benefit of all his creditors. The plaintiff took possession of the property by virtue of such assignment, and held the same until the twenty-seventh day of June, 1883, when the defendant, Walter H.
