In a discovery proceeding, the petitioner executor appeals from a decree of the Surrogate’s Court, Kings County, entered May 27, 1963 on reargument, which: (1) denied his motion to confirm the report of a Referee recommending, after hearings before him, that the respondent be directed to turn over to petitioner the proceeds of five checks in the aggregate amount of $6,154.80; and (2) granted the respondent’s cross motion to modify such report and to dismiss the petition.
