The defendant was charged with burglary. The judge charged the jury that he could be found guilty of burglary, which is punishable by imprisonment and labor in the penitentiary for not less than one nor more than twenty years, or of larceny-from the house where the property stolen from the house was valued at less than $50, his punishment would be as of a misdemeanor; and if the property stolen from the house was valued at more than $50, punishment would be from one lo ten years in the penitentiary.
