SANBORN, Circuit Judge.
The question which this appeal presents is whether or not the Rodger Ballast Car Company, a corporation, had a lien superior in equity to those of the bondholders secured by two prior mortgages upon the property of the Omaha, Kansas City & Eastern Railroad Company which were foreclosed in the court below. The question was presented by an intervening petition and was decided after, the foreclosure sale.
