1. The petition in this ease alleged that the plaintiff

owned certain shares of stock in a corporation, which were represented by a certificate of stock of a certain number, the value of which was stated; that this certificate of stock was loaned to the defendant for purpose of being used, as collateral by him to secure a temporary loan, and was to be returned to her when it had served its purpose, which she was assured would be in a short time; that he thus by deception and fraud obtained possession of her certificate of stock, appropriated it to his own use, and refused to deliver it to her…
