STEPHENS, Associate Justice.

Three hundred and ninety-three cattle shipped by appellee from Odessa, Texas, to Everts, South Dakota, were damaged en route, principally by delay at Wellington, Kansas, which was alleged by appellant to have been the unavoidable result of an unprecedented rainfall and flood in that section of the country which had washed away all the railway tracks leading out of Wellington in the direction of Everts.
