This suit was instituted for the benefit of the widow and children of Charles Arnold, deceased, by 'the administrator of his estate, against appellant, to recover damages accruing from the death of Charles Arnold through the alleged negligence of appellant. The suit was instituted under the Federal Employers’ Liability Act (45 USCA ■§§ 51-59; U. S. Comp. St. §§ 8657-8665), and that accounts for the suit being brought by the administrator, as the federal statutes require, for some unknown reason, that the suit is to be brought by a representative of the estate.
