The relator was convicted upon a plea of guilty of robbery in the third degree in the Court of General Sessions in and for the county of New York. He was sentenced to' imprisonment in a State prison at hard labor for a term the minimum of which should be not more than seven years, and the maximum should be not more" than fourteen years; not less than five years’ nor more than ten years of said term being imposed by the court as increased punishment as provided by section 1944 of the Penal Law.
