The defendant, Harold J. McCall, and his co-defendant, Carl Dixon, were charged in a two-count indictment with attempt murder and unlawful use of weapons in violation of section 8 — 4 and section 24— 1(a)(7) of the Criminal Code of Illinois (Ill. Rev. Stat. 1969, ch. 38, pars. 8 — 4, 24 — 1). After a bench trial, the defendants were found guilty of the unlawful use of weapons and sentenced to a minimum of two years and a maximum of five years. The defendants were found not guilty of the charge of attempt murder. Harold J. McCall appealed.
