HALE, Justice.

This is an appeal from an interlocutory order of the trial court refusing to grant appellant a temporary injunction. As plaintiff in the court below, appellant sought to enjoin the Citizens National Bank of Waco from voting 1,600 shares of stock in the Cooper- Company in favor of a partial capital liquidating dividend in the amount of $366,000. The Bank held the stock as independent executor of the estate of E. C. Barrett, deceased. Appellant also sought to enjoin the Cooper Company and its president, J. R.
