HOLTZOFF, District Judge.

This is a motion by the defendant for a new trial in an action to recover damages for the wrongful death of a child three days old. The jury returned a verdict for the plaintiff for $17,000.

The child’s mother was taken to the defendant, National Flomeopathic Hospital, shortly before his birth. In the last stages of labor, she was moved to the delivery room and placed on a delivery table.
