CLAY, Commissioner..Appellant was indicted for false swearing, and upon conviction was sentenced to one year in the penitentiary. On this appeal he contends that: (1) the testimony of a witness was incompetent; and (2) he should have had a directed verdict- of acquittal..

- -In the execution of a bail bond, appellant Rad signed an affidavit to the effect that he was the owner of real estate of the value of $11,000.
