This is an appeal by Thomas Alvin Millington, Defendant-Appellant, from a conviction for Second Degree Burglary and Safe Stealing. Appellant was charged by affidavit with the above two counts and trial was had to the court without the intervention of a jury. The trial court found Appellant guilty on both counts.
