OPINION

RUCKER, Judge.

This case involves the authority of the Board of School Commissioners of the City of Indianapolis 1 (“IPS”) to adopt a plan designed to raise, the academic achievement level of Indianapolis Public School students. The Indiana State Teachers Association (“ISTA”) and the Indianapolis Education Association (“IEA”) 2 filed suit contending IPS exceeded its authority in enacting a plan. IPS filed a motion for summary judgment which the trial court granted. ISTA and IEA now appeal contending the trial court erred in so doing. We disagree and therefore affirm.
