On October 3, 1883, Bedford Calwell filed his petition against the administrators of Allen T. Oaperton, in the circuit court of Monroe county, to settle his estate and to provide for the payment of his debts; alleging in substance, that on August 11, 1879, his brother, Lewis M. Calwell, then dead, was indebted to Allen T.
