Appeal from an order of the Supreme Court, Erie County (Kevin M. Dillon, J.), entered February 12, 2003. The order granted defendant’s motion for summary judgment dismissing the complaint in a personal injury action.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by denying *1181the motion in part and reinstating the complaint, as amplified by the amended bill of particulars, with respect to the permanent consequential limitation of use of a body organ or member and significant limitation of use of a body function or system categories…
