The plaintiff was the owner of riparian land on the Mississippi river situated a short distance above Little Falls, and described as “lot one (1), section twenty-seven (27), township forty-one (41), of range thirty-two (32).” He brought this action to recover for injuries to the premises caused by the defendant unlawfully and *419negligently building and maintaining piers and booms in the river, which caused log jams, which in turn caused the water to flow out of its natural channel and overflow plaintiff’s land.
