The appellant was charged with the crime of murder in the first degree, filed an answer of insanity, pleaded not guilty and was found guilty of murder in the second degree. He was sentenced to imprisonment in the state prison for life.
The assignment of errors states:
1. The court erred in overruling the appellant’s motion for a new trial.
2. The court erred in overruling appellant’s motion to quash.
3. The court erred in allowing the State to amend the indictment.
