Proceeding pursuant to CPLR article 78 to review a determination of the respondent- Commissioner of the New York State Department of Social Services, dated November 21, 1980 and made after a statutory fair hearing, which modified, and thereupon affirmed, a determination of the local agency to reduce petitioner’s grant of public assistance in the category of Aid to Dependent Children in order to recoup overpayments. Petition granted to the extent that the determination is annulled, on the law, without costs or disbursements, and respondents are directed to restore the benefits in question. The…
