This case presents the question whether the Metropolitan Transportation Authority [“MTA”], a public benefit corporation created by the State of New York, may refuse to display on its buses an advertisement that refers by first name to the Mayor of New York City, based on MTA’s belief that the advertisement violates § 50 of the New York Civil Rights Law.
