The writ of error brings for review judgment in habeas corpus proceedings remanding petitioner to the custody of the Chief of Police of the City of Arcadia.

It is the contention of the plaintiff in error that the affidavit on which the plaintiff in error was tried and convicted in the municipal court of the City of Arcadia which was in the following language: "Before me, Claud C. Jones, Mayor of the City of Arcadia, personally came Bunk McGuire who being duly sworn says that on the 4th day of June, A.D. 1936, in the City of Arcadia, aforesaid, one George Housh did sell intoxicating liquor…
