Bernard and Jennie Greenberg were buried in 1941 and 1958, respectively, in a cemetery maintained in the City of Albany by the Independent Benevolent Society (Society), of which Bernard Greenberg had been a member. In 1985, for reasons best known to themselves, defendants Lee Torf and Evelyn Berinstein, the Greenbergs’ surviving children, together with defendant Hyman Torf, arranged with defendants Robert Levine and Levine Memorial Chapel, Inc.
