—In an action to recover damages for personal injuries, (1) the defendant D & D Automotive appeals from an order of the Supreme Court, Suffolk County (Doyle, J.), dated April 15, 1993, which, after a trial on the issue of damages, granted the plaintiff’s motion to set aside as against the weight of the evidence the jury’s verdict, which was in favor of the plaintiff and against it in the principal sum of $769, and to direct a new trial, and (2) the plaintiff appeals from an order of the same court, dated May 13, 1993, *528which denied its motion for leave to serve an amended bill of particulars.
