MEMORANDUM AND ORDER
CASTEL, District Judge.
This interlocutory bankruptcy appeal turns in substantial part on the statutory construction of a provision of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (“BAPCPA”). 11 U.S.C. § 1141(d)(6)(A). The principal issue presented is whether the claims of certain plaintiffs in a qui tarn action brought under the False Claims Act (“FCA”) may be excepted from discharge under the provision of BAPCPA.
