|, The plaintiff homebuilder filed a petition seeking to recover the balance due on a construction contract. The defendants filed a reconventional demand in which they asserted a claim under the New Home Warranty Act (“NHWA”) and sought, inter alia, repair costs. After a bench trial, the court awarded plaintiff, Joe Cupit, $8,178.64 on his contractual claim, and defendants, Lyda and Isidro Hernandez, $80,000 on their NHWA claim.
