Black and poor residents in urban areas across the country have evinced in recent years a growing concern that property tax assessments discriminate against them. 1 Litigation against this discrimination has been notably unsuccessful, primarily due to the bar of the federal Tax Injunction Act of 1937. 2 See, e. g., Bland v. McHann, 463 F.2d 21 (5th Cir. 1972), cert. denied, 410 U.S. 966, 93 S.Ct. 1438, 35 L.Ed.2d 700 (1973) .
