BROTMAN, District Judge:

I. INTRODUCTION

Presently before the court is a consolidated appeal by the State of New Jersey Department of Environmental Protection of the bankruptcy court’s order selling the property of the debtor Perona Brothers, Inc. to Frank Perona, free and clear of the appellant’s Ken. Also before the court is a motion to dismiss these appeals by Trustee James J. Cain.
