TERNUS, Justice.
This appeal involves the imposition of penalty benefits on an employer and workers’ compensation carrier who contested an employee’s entitlement to disability benefits. The district court, on judicial review, affirmed the award of disability benefits, but reversed the award of penalty benefits. The employee’s appeal was transferred to the court of appeals where the district court ruling on the penalty benefits issue was reversed and the industrial commissioner’s award of such benefits was affirmed.
