Nilda Colón-Millín (“Colón”) filed a tort action against Sears Roebuck of Puerto Rico, Luis Matos-Colón (“Matos”), his wife and their conjugal partnership, and Liberty Mutual Insurance Company, 1 asserting that a Sears van, driven by Matos, struck her as she was walking across a street in San Juan, Puerto Rico. Her complaint, filed in federal district court on the basis of diversity jurisdiction, sought damages for pain and suffering, loss of income, and medical bills.
