GIVAN, Justice.

This is an appeal from the denial of post-conviction relief. In 1977, appellant was convicted of first-degree burglary and found to be a habitual offender. He originally was sentenced to a ten (10) to twenty (20) year term for burglary, which was enhanced by thirty (80) years by reason of his being a habitual offender.

The cause was appealed to this Court, Beavers v. State (1984), Ind., 465 N.E.2d 1388. In a unanimous opinion authored by Justice DeBruler, this Court found that the habitual offender statutes in force at the time the burglary was committed were Ind. Code §…
