DURHAM, Associate Chief Justice:
This case comes before us on a writ of certiorari to the court of appeals. The petitioner, Maxcine Archuleta, argues that the court of appeals erred in upholding the trial court’s denial of Archuleta’s motions (a) to amend her complaint to conform to the evidence, (b) for summary judgment, (c) to com*411pel discovery, and (d) in affirming the trial court’s refusal to give jury instructions on agency. We affirm.
