Appellant was tried, convicted and sentenced for the offense of grand larceny.1 Count 1 of the indictment on which ap*267pellant was tried charged James G. Cross, James Landriscina and others not named as defendants, with conspiracy, in violation of 18 U.S.C. § 371 and § 1503 (1958), to effect a corrupt acquittal of Gross in his trial on a charge of perjury.
