This ease came before a hearing panel of this court for oral argument January 16, 1990 pursuant to an order which had directed both parties to appear in order to show cause why this appeal should not be summarily decided. The plaintiff had appealed from a summary judgment entered in the Superior Court.
After hearing the arguments of counsel and examining the memoranda filed by the parties, we are of the opinion that the trial justice was correct in granting summary judgment in favor of the defendant, since an abutting owner of real estate has no duty to pedestrians to remove ice and…
