The appellants, Claude Tschiffely, Dolly T. Myers, and C. Stott Tschiffely, plaintiffs below, appeal from an order of the District Court of the United States for the District of Columbia dismissing their amended complaint, upon the ground that it was wanting in equity. By this complaint, the appellants sought to establish and enforce an express trust of lands of which, as children of one Frederick A. Tschiffely, Jr., deceased, they claim to be beneficiaries.
