*344This action was brought by the defendant in error against the plaintiff in error to recover damages for a personal injury alleged to have been inflicted upon him by the negligence of the latter’s agents while the former w'as upon the train of the latter as a passenger. The jury, under a proper charge, rendered a verdict against the plaintiff in error, and judgment was entered thereon, and the railway company has appealed and assigned errors.
