Louise Corbett Smith and others, as legatees under the will of R. J. Corbett, filed this petition in the court of ordi*519nary of Colquitt County against the Trust Company of Georgia, as executor under the will of E. J. Corbett. The petition alleged that E. J. Corbett died January 18, 1929, and the Trust Company of Georgia on March 4, 1929, qualified as executor under the will.
