In an action, inter alia, to recover unpaid rent, the defendant *773appeals from an order of the Supreme Court, Westchester County (Collabella, J.), entered July 5, 2005, which granted that branch of the plaintiffs motion which was pursuant to CPLR 3211 (a) (7) to dismiss the counterclaims for failure to state a cause of action.

Ordered that the order is affirmed, with costs.
